By Appellant’s Notice filed on 15 July 2022, the Appellant (Defendant below) seeks permission to appeal the Order of Mr Campbell Forsyth (sitting as a Deputy Judge of the High Court) by which he revoked patent EP(UK) 3 138 606 B1 in a patent revocation action with an infringement counterclaim) about cochlear implants.
The Judge held the patent to obvious. In parallel European Patent Office proceedings, the patent has been upheld, in the amended form defended by the Appellant in the UK proceedings.
