The Claimants (C’s) appeal against the decision made by Sheldon J when handing down judgment on 23 April 2024 striking out/ granting summary judgment dismissing C’s claims against the 2nd Defendant, Lupton Fawcett LLP.
The C’s are 43 companies which were the vehicles for a large Ponzi fraud resulting in C’s liquidation with a deficiency to creditors of £68M.
The underlying claim is for professional negligence against C’s former solicitors. C’s allege that they would not have entered into the transactions they did if properly advised, and that they would not have incurred the substantial losses.
The judge held that the C’s had failed to establish that they had suffered any loss as a result of the alleged negligent advice by D.
