The Appellant sought to challenge the SSHD’s decision of 30 March 2021, maintained on administrative review on 04 May 2021.
The Appellant’s application to the SSHD was based on his proposal to take over a specialist grocery store. The SSHD refused the application on the basis that the Appellant had not shown he had any relevant experience or qualifications and was not satisfied that the business proposal had a realistic chance of success. Knowles J. found that the SSHD was entitled to be concerned about the absence of evidence and that the business did not sufficiently address this. The decision, in the round, was one the SSHD was entitled to reach.
