This is an appeal against the decision of the Upper Tribunal Immigration and Asylum Chamber promulgated on 3 November 2023.

The Appellant is a citizen of Pakistan born in 1981 who entered the UK in June 2008 with his family on a visit visa. He was served with removal papers after which he submitted an application for Leave To Remain on the basis of his Human Rights. The respondent refused the application on 2 December 2020. The First Tier Tribunal allowed the appeal finding that he did have a family life in the UK and removing him would cause interference to this.

The respondent appealed the decision and at the hearing the Upper Tribunal found that an error had been made by the FTT and went to re-make the decision by dismissing it. The UT found that removal would not be a breach of article 8 rights and therefore dismissed the appeal.
