Appeal against the order of Mr Justice Lane dated 7 January 2022 whereby the application for judicial review was dismissed.
The Appellant, Ashchurch Rural Parish Council, sought to challenge the grant of planning permission on 22 April 2021 by the Respondent, as local planning authority, for the development of inter alia a road bridge over the Bristol to Birmingham mainline railway.
The judge concluded there was no irrationality in what the Report and Development Officer told the Planning Committee, particularly regarding balancing the harm to listed buildings and public benefits – it went no further than was appropriate.
