Ashraf (claimant/appellant) v Dominic Solicitors & ors (defendants/respondents)

Thursday 1 December 2022

This is a second appeal. By appellant’s notice filed on 15 July 2022, the claimant/appellant appeals the order of Johnson J dated 27 June 2022, whereby he dismissed the appeal against the order of Deputy Master Lloyd dated 18 December 2019 and made consequential costs orders.

This was an appeal by the claimant, in her capacity as the executrix of the estate of Mr Ul Haq, against DM Lloyd’s order, where he acceded to the applications of D1, D2 and D7 for summary judgment of claims brought against them by the estate and dismissed the claims and made costs orders against the claimant. D1 is a firm of solicitors, D2 a solicitor within that firm and D7 is also a firm of solicitors. In brief the claimant’s case was that the Deceased’s title to a property was transferred as a result of fraud and that the Defendants breached their duties of care in tort causing loss to the deceased in respect to which the estate is entitled to recover damages.
