By Appellant’s Notice filed on 22 August 2023, this is an appeal against the order of Mr Justice Eyre, sitting in the Administrative and Planning Court, Birmingham, dated 1 August 2023.
The Claimant sought to challenge the Local Authority’s decision to vary the Abatement Notice served by the Council on Real Motorsport Ltd to restrict the statutory nuisance arising from Mallory Park Racing Circuit. Eyre J dismissed the claim finding that the local authority did have power to make the variation.
