By Appellants Notice filed on 14 May 2021, the three Claimants appeal the order of Richard Hermer QC sealed on 14 May 2021 following his judgment on liability in respect of the First Claimant’s claim, dated 31 March 2021, sitting as a Deputy High Court Judge in the Queen’s Bench Division whereby he dismissed their claims and made consequential costs orders.

Split trial of liability in respect of C1’s claim for damages for personal injury arising out of his collision, aged 11, with D1’s car on 7 October 2015 when C1 was crossing the road in front of his home. C1 suffered orthopaedic and traumatic brain injuries. C2 and C3 (his parents) brought a claim for psychiatric injury. Their claim was adjourned pending the outcome of the liability trial. D2 is D1’s car insurer. Dispute as to whether C1 ran out into the road or not.
