By Appellant’s Notice filed on the 12 January 2024, this is an appeal against the decision of Mr Justice Calver, sitting in the Administrative Court, dated 15 December 2023 whereby he allowed the Judicial review claim.

The respondent, a 17 year old, presented himself as homeless to the Appellant local authority and sought support, asserting the applicant had a duty to support him and provide accommodation under s.20 Children Act 1989, and that this duty arose due to the local authority making arrangements for him to stay with his friend’s mother.

In August 2021, the respondent’s solicitors challenged what they said was the Appellant local authority’s failure to adequately exercise their discretion to provide the respondent with appropriate support.
The respondent sought judicial review of the actions of the Appellant council.
