The Appellant appeals the order of Thornton J. of 07 July 2023 by which she dismissed the judicial review claims.
The Appellant sought to challenge grants of “development consent” for three related road development schemes on the A47 in Norfolk. It was argued in each case that the Respondent had failed in each case to assess the significance of the cumulative greenhouse gas emissions from the related Schemes, as required by the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017.
In the second and third cases the Respondent had purported to do the evaluation and the Appellant says that, if this was done, it was not done lawfully.
