The Claimant appeals the ruling made by Mr Alexander Nissen KC following a trial of liability in a procurement case in which the Claimant as unsuccessful tenderer complained that the Defendant was in breach of the Public Contracts Regulations 2015 when it awarded the contract to the preferred bidder.
The trial included determination of whether any breaches found were sufficiently serious to justify an award of Francovich damages.
The claim for damages was dismissed.
