British Telecommunications PLC –v- Her Majesty’s Treasury & another

Appeal against the Order of a Divisional Court (28 November 2018) that granted permission to apply for judicial review in respect of grounds 1 (The supposed property rights of BTPS members) and 1A (Error of law implementing indexation via an amendment to the PCSPS would not have been ultra vires), then dismissed the claim and refused permission to apply for judicial review on all other grounds.

BT applied for judicial review of the decision of HM Treasury to implement an extension of the provision of full indexation of the guaranteed minimum pension payable to all members of public service pension schemes who reach state pension age between December 2018 and April 2021.

BT has a private sector pension scheme. The obligation in this matter would cost BT around £120 million.
