By Appellant’s Notice filed on 11 January 2024, the Defendant appeals against the order made by Martin Bowdery KC (sitting as a Deputy High Court Judge) dated 20 November 2023 granting the Claimant’s strike out application and striking out paras 21-25 of the defence, and dismissing the D’s cross-application to strike out the claim.
The dispute concerns a site of which D owns 71% and C owns 29%.
The claim arises out of the award of a contract by D to a developer (MGD) and entry into that contract by MGD and D.
