Both parties appeal the order of His Honour Judge Stephen Davies (sitting as a Judge of the High Court), sitting in the Technology and Construction Court, dated 30 August 2024 by which the judge ordered that further to his judgment handed down on 21 June 2024, D was to pay C the sum of £8,985,79.50 plus interest.
This was the sum determined as due for period 16 June 2016 to 31 March 2023 as a result of the judge’s construction of provisions concerning the sharing of third party income contained in a 30-year contract concluded between parties for the provision of waste management services.
The claimant appeals on the basis that the sum should be revised up. The defendant appeals the award of the sum.
