Burnford & ors (claimants/appellants) v Automobile Association Developments Ltd (defendant/respondent)

By appellant’s notice filed on 4 April 2022, the appellants/claimants appeal the order of HHJ Matthews, sitting as a Deputy High Court Judge, dated 28 February 2022, whereby he struck out their claim.

The claimants were shareholders in Motoriety (UK) Ltd (“the Company”), a business relating to a personal motoring administrative hub and an online garage directory and booking platform. The defendant was a subsidiary of AA plc. The parties entered into an Investment Agreement, but the Company went into administration and was finally dissolved in 2019. The claimants claimed damages for fraudulent or negligent misrepresentation and/or breach of contract by the defendant. The defendant made an application to strike out the claim, which HHJ Matthews granted.
