C3 & anr v The Secretary of State for Foreign, Commonwealth & Development Affairs

An appeal from a decision of the Divisional Court (Lewis LJ and Jay J) dated 2/11/22 dismissing C3 and C4’s application for habeas corpus.

C3 and C4 are both held in Camp Roj in N.E. Syria which is operated by the Autonomous Administration of North and East Syria (“AANES”). They are both British Citizens who travelled to Syria some years ago to align with ISIL. They were deprived of their British citizenship in 2019 but it was restored after SIAC held it would render them stateless.

C3 and C4 submit that AANES have made it clear that C3 and C4 and their families would be released if an “official request” were made by the UK. The Secretary of State has refused to make such a request, principally on the grounds that they travelled to Syria voluntarily and remain a threat to national security.
