Canada Goose UK retail Ltd & Anr –v- Persons Unknown and PETA

4th – 5th February 2020

The Appellants appeal against the order made by Nicklin J dated 20 September 2019 dismissing their application for summary judgement. The interim injunction made against the Defendants was discharged.

The High Court Judge granted permission to appeal and granted a stay of the part of his order discharging the injunction.

The Appellants had sought an injunction against protesters opposed to the sale of fur and animal products at their shop in Regent Street, London. The injunction sought was to stop alleged acts of harassment, trespass and nuisance arising from the protest.

The judge held that the case raised important issues in relation to the grant of interim injunctions against persons unknown generally and particularly against those engaged in protests.
