By an Appellant’s Notice submitted on 12 April 2024, the claimant and respondent below, appeals the judgment of Spencer J, sitting in the King’s Bench Division, handed down on 2 February 2024 and his consequential order dated 15 March 2024 allowing the defendant’s appeal, setting aside paragraphs 1 to 4 of the order of Recorder Dagnall dated 15 July 2022 which found in favour of the claimant.
Background: On 14 December 2017 the claimant was arrested by Essex Police officers further to allegations by two women that they had been assaulted by the claimant in a pub. The police were called, and the claimant was arrested. The claimant denied the alleged assaults and claimed he had been racially abused by the women. He was subsequently tried and acquitted. The Chief Constable of Essex Police is the defendant below.
The claimant brought a claim issued at the County Court Money Centre on 22 October 2020 for battery regarding the various use of force he was subjected to whilst at the custody desk and whilst in cells. He claimed damages for physical and psychiatric injuries, injury to his feelings, special damages and aggravated and exemplary damages.
