By Appellants Notice filed on 17 May 2023, the Competition & Markets Authority (CMA) appeal a decision of the Competition Appeal Tribunal (CAT) dated 31 March 2023 as recorded in its order dated 20 April 2023.
Appellant suggests the appeal raises a novel point of law which has general importance for the Competition & Markets Authority’s powers and the effectiveness of the market investigation regime.
On 22 November 2022 the CMA made a reference for a market investigation into the supply of mobile browsers, mobile browser engines and the distribution of cloud gaming services through app stores on mobile devices in the United Kingdom. The reference was made pursuant to section 131 of the Enterprise Act 2002 (“EA”).
