This is an application by East Quayside 12 LLP (first interested party below) to appeal the Order of Holgate J. of 01 November 2022 by which he allowed the Application of the Council and quashed the Inspector’s decision of 06 My 2022 under section 288(5)(b) of the Town and Country Planning Act 1990, ordered costs in favour of the Council and refused East Quayside 12 LLP permission to appeal.
The inspector had allowed an appeal brought by the applicant against the refusal of planning permission. The inspector granted permission for a residential development.
