Debenham Antiques Ltd v Easter & anr

Appeal against the Order of HHJ Evans-Gordon (sitting as a Judge of the High Court) (16 October 2019) that ordered that the Council pay costs to Mrs Easter and that Debenham Antiques Ltd (the Appellant in this matter) pay her costs also.
Mrs Easter sought to quash the grant of planning permission by Mid-Suffolk District Council to Debenham Antiques Ltd. She was successful, after the signing of a consent order, and the issue then became who should pay costs and the appropriate quantum. Debenham Antiques Ltd denied ever taking on the risk of defending the Council’s position, the learned Judge disagreed with that stance and made comment regarding their involvement.
