By an Appellant’s Notice, filed on 29 April 2024 the Defendants below appeal the Order, dated 25 March 2024 of Dias J DBE sitting as a High Court Judge in the Commercial Court, in which the Judge dismissed the Defendant’s claim and made a costs order.
The Appellants who are Underwriters, had an indemnity under a policy of war risks insurance with the Claimants which concluded on 29 June 2018. The Claimants are owners, managers and mortgagees of the vessel “Win Win”.
The Vessel was detained in Indonesia in February 2019 by the Indonesian Navy under the laws of Indonesia. In August 2019, whilst the Vessel was still detained, the Claimants served a Notice of Abandonment and commenced proceedings. The Vessel was released in January 2020. Under the terms of the Policy if the Vessel was detained be reason of an insured peril for more than six months, she was deemed to be a constructive total loss.
