By Appellants Notice filed on 28 September 2022, the Department for International Trade (DIT), now the Department for Business and Trade, appeal the decision dated 13 April 2022 of the Upper Tribunal, Administrative Appeals Chamber, whereby they:
(1) allowed Mr Montague’s appeal from the decision of the First tier Tribunal (Information Rights) (FTT) dated 26 August 2020;
(2) sett aside that decision and remitted Mr Montague’s appeal to be considered afresh by the FTT
(2) dismissed the DIT’s appeal from the FTT decision dated 26 August 2020.
