By Appellant’s Notice submitted on 17 November 2023, the applicant seeks permission to appeal, with appeal to follow if permission is granted, the decision of Deputy Upper Tribunal Judge Hocking, dated 14 June 2023, to dismiss the appeal from the decision of the First tier Tribunal.
The issue is whether the First tier Tribunal’s decision of 21 January 2021 should stand despite certification that the Appellant lacked capacity in the First tier Tribunal proceedings.
