By Appellants Notice filed on 20 February 2023, the Appellant Easygroup Limited (the Claimant below) appeal the order of Sir Edward Mann sitting at the Business and Property Courts as a judge of the High Court dated 9 February 2023.
The Claimant is a member of the well-known “Easy” group of companies. The First Defendant is a company incorporated by the Second and third Defendants to develop and market software and other services for the auctioneering trade.
The Claimant made a claim for trade mark infringement, passing off and declaration of invalidity of the Defendant’s mark. The Defendants counterclaimed for revocation of various uses of various of the claimant’s marks. The Claimant’s claim under TMA s10(2) failed; the claim under section 10(3) succeeded in respect of some marks; the claim for passing off failed; the claim for declaration of invalidity of defendant’s mark failed; the Defendant’s counterclaim largely succeeded.
