By Appellant’s Notice filed and sealed on 25th March 2022, the 10th Defendant appeals paragraph 4 of the Order of the Honourable Mr Justice Calver dated 16th February 2022 entering judgment for the Claimant and paragraphs 3, 4 and 7 of the consequential Order of 4th March 2022 regarding costs.
Background – The Claimant alleged that it was the victim of a high value metals fraud wherein the First Defendant, Come Harvest, who is not a party to this appeal, used fraudulent documents in order to obtain finance from the Claimant under bogus sale and repurchase (repo) transactions. The Claimant alleged that it had suffered losses of US $284,536,139.23 as a result of the fraud and brought claims by way of a series of different and distinct causes of action against different defendants in order to recoup some of those losses. The detailed judgment of Calver J at paragraph 20 onwards sets out the parties to the claim and their relationship with each other.
