By Appellant’s Notice filed on 14 August 2022, the Claimant appeals against the order made by Charles Bagot KC sitting as Deputy High Court Judge dated 29 July 2022 dismissing C’s applications dated 2 May 22 for relief from sanctions imposed by the order of Foxton J dated 13 April 2022 and dated 22/5/22 to set aside the order of McGowan J dated 5 May 2022.
The background is that D2 obtained a default judgment against Mr Elo on 23/10/20. D2 then obtained a writ of control against him on 5/11/20 and instructed the seizure of 8 vehicles. But the care did not belong to Mr Elo but to the appellant (A).
A applied for injunction against D1 in April 2022; On 13/4/22 Foxton J made injunction restraining D1 from offering for sale or selling the cars.
