EMFC Loan Syndications LLC (claimant/appellant) –v- The Resort Group PLC (defendant/respondent)

The claimant appeals the order made by HHJ Pelling QC (sitting as a HCJ) in the Commercial Court dated 9 June 2020.  The Judge awarded Claimant damages in the sum of £94,576 but ordered C to pay D’s costs of the claim.  C is seeking damages of over Euro1m, including compound interest, and for D to pay C’s costs of the claim.

This was a trial of a claim for commission allegedly due under a services agreement.  The claim was mostly dismissed except for 10% of the value of the claim.
