Ensygnia IP Ltd (claimant/appellant) v Shell UK Oil Products Ltd & ors (defendants/respondents)

Wednesday 6 November 2024

By an Appellant’s Notice, filed on 8 November 2023, the Appellant appeals the Order, dated 12 March 2024 of Charlotte May KC, sitting as a Deputy High Court Judge, dated 26 June 2023, sitting in the Business and Property Courts, Intellectual Property List.

By this action, the Claimant sued the Defendants for infringement of the Patent. The Defendants denied infringement and counterclaimed for revocation.

The Patent concerns a method and a system for identifying a user so that it can obtain access to a registered service. It involves the use of graphical encoded information or graphical object (for example in the form of a barcode or QR code) that is displayed on a display of a computing apparatus and scanned by the user’s mobile device (such as a mobile phone). The information is either decoded by the mobile device or by a server. Either way, the server establishes the identity of the user to determine if the user is registered, and if so, authorises the user to access the service.

The alleged infringement is a mobile payment system comprising a mobile phone app which can be used by registered customers at Shell petrol stations to purchase fuel.
