Appeal against the decision of the Upper Tribunal Immigration an Asylum Chamber promulgated on 9 September 2022.

The appellant, a citizen of Iran with Kurdish ethnicity, arrived in the UK on 4 December 2019 and applied for asylum on 5 December 2019. The respondent refused his asylum claim on a decision dated 17 November 2020. His asylum claim was made on the basis that he feared the Iranian government owing to his activities for the KDPI in Iran and the UK. The appellant appealed this decision in the First Tier Tribunal where Judge Bannerman dismissed the appeal as it was not accepted that such a low-level profile would lead to any adverse perception by the Iranian authorities so as to put him at risk. The matter was then heard by the Upper Tribunal on 22 July 2022 with the decision promulgated on 9 September 2022.
