By Appellant’s Notice filed on 15 March 2024, the Claimants appeal against the order made by Nicklin J, Sitting in the King’s Bench Division, Media and Communications List, dated 23 February 2024 striking out their claims.
The Defendant applied to strike out/ dismiss the claims of all Claimants in a multiparty claim for breach of data protection/ misuse of private information.
The judge held that the claims of all but 14 of the Claimants’ claims should be struck out. In the alternative, summary judgment would have been granted for the D against the dismissed Cs.
The Cs are over 400 current or former police officers of Sussex Police. They brought claims for breach of the GDPR and/or Data Protection Act 2018 and/or misuse of private information.
The D administers the Cs’ pension scheme. D sent Cs’ annual pension benefit statements to out of date addresses.
