Friends of the Earth (claimant/appellant) v Secretary of State for International Trade & ors (defendants/respondents)

Tuesday 6 – Thursday 8 December 2022)

By Appellant’s Notice sealed 29/4/22, this is an appeal against the Order of Stuart-Smith LJ and Thornton J dated 17/3/22, sitting in the Administrative Court, that dismissed the claim for judicial review.

The Appellant, Friends of the Earth, is a not-for-profit organisation that undertakes campaigning and other work in furtherance of environmental protection objectives for and in the public interest. FoE challenges the decision of the Secretary of State to provide up to USD 1.15 billion in export finance and support in relation to a liquefied natural gas project in Mozambique. The decision was in fact made by Mr Louis Taylor, the Chief Executive Officer of United Kingdom Export Finance, formally exercising his delegated power under section 1 of the Export and Investment Guarantees Act 1991.
