By Appellant’s Notice filed on the 12 February 2024, this is an appeal against the decision of Mr Justice Lane, sitting in the Administrative Court, dated 22 January 2024 whereby he dismissed the Judicial review claim.

The claimant is a national of Jamaica. On 28 April 2014, the defendant decided that the applicant’s deportation was conducive to the public good, pursuant to section 3(5)(a) of the Immigration Act 1971. This decision was served on 1 May 2014 due to his conviction in January 2007 for GBH and sentence of 6 years detention when he was aged 17 years. The decision was appealed and went to the Court of Appeal and was also dismissed. The matter was pursued to the Supreme Court. During this time the applicant was detained. The Supreme Court refused permission to appeal on 15 February 2022.

The issue at the substantive hearing was whether deportation order was unlawful by reason of the claimant’s then pending application for permission to appeal to the Supreme Court.
