By Appellant’s Notice filed on 29 June 2023, the Claimant (C) appeals against the order made by the Employment Appeals Tribunal (EAT) sealed on 12 June 2023 allowing the Respondent’s/ GMC’s appeal and remitting matter to differently constituted ET.
The Employment Tribunal had upheld four complaints made by C of direct race discrimination. Those complaints were remitted.
On appeal to EAT, the EAT concluded that ET failed to engage with key aspects of the case and so produced a result that was not Meek-compliant, and reached some contradictory findings. In particular ET did not make it clear whether certain complaints had been upheld.
