Gill (appellant) v Lees News Limited (respondent)

By Appellant’s Notice filed on 10 February 2023, the Defendant Harmohinder Singh Gill (as Trustee of the Gillcrest UK Pension Scheme) appeals the order of Richards J sitting at the Business and Property Courts, Chancery Division, dated 23 January 2023 by which he dismissed the Defendants appeal against the order of HHJ Monty KC dated 12 May 2022 save one ground on costs which was agreed by consent.

The Claimant Lees News Limited is the tenant and the Defendant is the landlord of the property. On 31 August 2018, the Claimant’s then solicitors served Notices on the Defendant in respect of both 4 and 4A under section 26 of the Landlord and Tenant Act 1954, requesting new tenancies. The Defendant’s solicitors wrote opposing the renewal of both leases under section 30(1)(a), (b), (c) and (f) on the basis of breach of repair and maintenance obligations, persistent delay in paying rent, other substantial breach and intention to demolish or reconstruct.

Following trial, HHJ Monty KC found in favour of the Claimant that none of the grounds of opposition to the proposed new tenancies were made out.
