By Appellant’s Notice submitted on 13 September 2024, Greenfields (IOW) Limited, claimant below, appeal the decision of HHJ Jarman sitting as a Deputy Judge of the High Court dated 23 August 2024, following a rolled-up hearing, granting permission to apply for judicial review on limited grounds and dismissing the claim;
By a notice dated 4 August 2023 issued to the agent of the interested party (Westridge) the defendant as local planning authority granted conditional planning permission for development of agricultural land in Ryde, Isle of Wight. The permitted development includes 473 new dwellings (with 35% affordable housing), café, doctors surgery, office space and associated site infrastructure.
The claimant (Greenfields) challenged the grant by way of judicial review on five grounds.
