Guardian News & Media (appellant) v The Executor of HRH The Prince Philip, Duke of Edinburgh (claimant/respondent)

Wednesday 20th – Thursday 21st July 2022

By an Appellant’s Notice filed at this Court on 29 October 2021 , this is an appeal against the decision of the President of the Family Division, dated 16 September 2021. The appellant is the Guardian News and Media, who appeal the decision to hold the hearing in private that ordered the sealing up of the last will and testament of HRH the Prince Phillip, Duke of Edinburgh.

The case involves the last will and testament of HRH the Prince Phillip, Duke of Edinburgh. The decision of the PFD followed an application of the Executor that the will be sealed up and no copy should be made for the record or kept on the court file. An application for a direction to exclude the value of the estate from the grant of probate was also requested. The Attorney General was the sole defendant to the Summons (whose role was to represent the public interest). The President decided, first, to hold the hearing in private and subsequently, that the Executor’s applications should be granted.
