By Appellant’s Notice filed on 02 December 2022, the Appellant appeals the Judgment of Deputy High Court Judge Stuart Isaacs KC, sitting in the Business and Property Court. On 20 October 2022 he gave Summary Judgment in favour of the Respondent and on 11 November 2022 he ordered that the Applicant make an interim payment of around £2.3 million to the Respondent on account of the full value of loans that had been advanced to the Appellant.
Background – The Appellant is a company owned in equal shares by the Respondent and his two brothers-in-law. They were in business together for over 20 years. There was a falling out between the Respondent and his two brothers-in-law, with allegations of misconduct being made in both directions. The Respondent was removed as a director of the Applicant in October 2021.
