This is an appeal against the decision of David Elvin QC sitting as a Deputy High Court Judge of 07 July 2022, by which he quashed the Applicant’s decision dated 19 January 2022 and remitted to the London Borough of Hillingdon the Respondent’s appeal under s.78 of the Town and Country Planning Act 1990.
The decision challenged below was that of the inspector to dismiss the Respondent’s appeal and refuse to grant planning permission for the subdivision of an existing 4-bedroom dwelling to provide one 3-bedroom dwelling and an additional 2-bed unit with associated garden and parking.
