By Appellant’s Notice filed on the 21 March 2024, this is an appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber) sealed on 18 March 2024, refusing an application for permission to apply for judicial review after an oral hearing.
The Appellant is a national of Eritrea. She resides in the UK lawfully with leave issued under Appendix FM on the basis of her role as the parent and primary carer of two minor British children. On 12 June 2023 the appellant applied for a Certification of Travel based on being a citizen of Eritrea. The Appellant told the Respondent that she applied for an Ethiopian passport, but the Ethiopian Embassy in London declined to recognise her as Ethiopian and she is unable to ask Eritrean authorities as she is afraid of them. On 1 September 2023 the Respondent refused the application on the basis the Appellant’s passport application had not been unreasonably refused by the national authorities.
