KLG Trucking SRL (appellant) v The Secretary of State for the Home Department (respondent)

By appellant’s notice filed on 29 December 2023, KLG Trucking SRL, first appellant below, appeal the order of HHJ Owen, sitting in the County Court at Nottingham, dated 8 December 2023 dismissing the appeal and upholding civil penalties.

Background: The applicant is a limited liability entity incorporated in the Republic of Romania and was at all relevant times engaged in the international transport of goods including from member states of the European Union into the United Kingdom.

Having entered the UK Control Zone at the Port of Calais, Border Force Officers conducted a search of the Vehicle; that search revealed the presence of eight clandestine entrants concealed in the trailer.

Civil Penalties were imposed against the applicant as the owner of the vehicle in the sum of £10,000 for each of the eight clandestine entrants carried, a total penalty of £80,000. Penalties were also imposed against the driver of the vehicle, in the sum of £6,000.00 for each of the five clandestine entrants carried, a total penalty of £48,000.
