The appellant (as in the Upper Tribunal) is a citizen of Albania. He came to the UK in 2005 and was granted leave to remain on 6 September 2007 on the basis of marriage to a British citizen. On 5 February 2009 he was naturalised. In 2018 the appellant was convicted and sentenced to 6 years. On 22 January 2021 the respondent decided to deprive the appellant of his citizenship on the grounds of conduciveness to the public good. The First Tier Tribunal dismissed the appeal finding the respondent acted rationally.
The Upper Tribunal dismissed the appeal finding that the FTT made an error of law in that the respondent failed to exercise her discretion and in absence of the respondent’s undertaking this, the appeal was allowed.
