By Appellant’s Notice filed on 6 March 2023, the Appellant below (A) appeals the Order, 17 February 2023, of Deputy Circuit Judge Gregory sitting in the Coventry County Court in which he dismissed an appeal under s204 of the Housing Act 1996 against the review decision of the Respondent local authority dated 24 August 2022 that A was intentionally homeless; and made consequential costs orders.

Issue: Can a person evicted from hostel accommodation under an excluded licence be found to be intentionally homeless.

Background: A was required to vacate his room in hostel accommodation because of complaints about his behaviour. A was determined to have occupied the hostel accommodation under an excluded licence which was not afforded any protection by the Protection from Eviction Act 1977 which meant that he could be evicted without the need to serve a notice to quit. The Respondent local authority decided on 2 April 2022 that A was intentionally homeless as a result of the eviction. That decision was upheld in a review decision by the Respondent on 24 August 2022.
