By Appellant’s Notice filed on 21 June 2024, Leicester City Council (LCC) appeals against the order made by HHJ Tayler, sitting in the Employment Appeals Tribunal (EAT), sealed on 4 June 2024 dismissing LCC’s appeal from the decision of the Employment Tribunal (ET).

The EAT held that the ET did not err in law in holding that the burden of proof had shifted to the LCC to disprove discrimination and that it had failed to do so.

C was employed by LCC as Head of Service for Locality West. The background is that C complained that LCC made false allegations against her and transferred her from her role and caused a disciplinary investigation to be carried out against her. C in consequence complained of direct race discrimination.

The ET decided that the burden of proof had passed to LCC in view of the disparity in treatment between her and white employees who might also have been subject to formal disciplinary investigation but were dealt with informally.
