By Appellant’s Notice filed on 18 July 2022, the Appellants (Defendants below) appeal the two Orders of Mrs Justice Joanna Smith dated 29 June 2022 by which: (1) the Defendants’ plea of bad faith was struck out, (2) the Claimant was granted permission to rely on survey evidence and (3) consequential orders regarding service of amended pleadings and adducing expert evidence and disclosures were made.
Background: This case concerns trademark litigation between Lidl (the Claimant below) and Tesco (the Defendant below) in the latter’s stores. The Claimant estimates damages of several millions of pounds.
