Applications for permission to appeal, with appeal to follow if permission is granted, of the Order of Douglas Campbell KC dated 5 June 2023 that dealt with costs and permission to appeal and the order of Morgan J dated 22 July 2020.
The appeal related to Lufthansa’s successful patent infringement action, Lufthansa having elected for an account of profits against each defendant. A liability trial took place before Morgan J in June and July 2020. He held that the patent was valid, and that the defendants’ EmPower Systems were, when assembled, (aircraft passenger) power supplies according to claim 1 of the patent (on a normal construction).
