This is an appeal by the Financial Services Compensation Scheme against the Order of Dexter Dias KC (sitting as a Deputy High Court Judge) of 15 September 2022 by which he allowed the judicial review claim of the respondents, declaring that the Appellant’s decision was wrong in law and that the Respondents are entitled to be compensated for their claims for unpaid costs and interest, quashing the Applicant’s decision and ordering reconsideration of the Respondent’s application for compensation in accordance with the findings of the Court, and ordering costs in favour of the Respondents.
