This is an appeal against the decision of His Honour Judge Hodge KC (sitting as a Judge of the High Court) dated 16 March 2023, whereby he made orders which, among other matters, require the appellant to draw down an occupational pension into a specified bank account, to be notified to the Respondent. The appeal is brought on a single ground, namely that the order is not permitted pursuant to s.91(2) of the Pensions Act 1995 (“PA1995”),
which prevents the court from making an order “the effect of which would be that the appellant would be restrained from receiving that pension.”
