Moakes (appellant) v Canterbury City Council (respondent)

By an Appellant’s Notice submitted on 14 June 2024, the claimant below appeals the order of HHJ Robinson, sitting in the Administrative and Planning Court, dated 24 May 2024 dismissing the claimant’s application for judicial review and awarding costs to the defendant.

On 8 September 2023 the defendant (the Council) granted hybrid planning permission, comprising full permission for the expansion of Canterbury Business Park to create 11,900 sqm winery with associated parking and landscaping and outline proposals with all matters reserved except access for up to 8,000 sqm of warehousing. The site is located within the Kent Downs Area of Outstanding Natural Beauty, the North Kent Downs Area of High Landscape Value and the Highland Court Conservation Area. The Site is, therefore, said to be in a highly sensitive area in both heritage and landscape terms.

The Claimant, who is a local resident, objected to the Proposed Development and applied to quash the Permission.
