Mostyn House Estate Management Company Limited (`MHEMC’), appeal the Order of Crawson J QC dated 25 August 2021 whereby he dismissed the Claimants claim, ordered the Claimant to pay D1 and D2 costs.
Factual background: The claim concerns the interpretation of the instruments transferring the freehold interests of residential properties at Mostyn House and particularly whether MHEMC is entitled to (1) maintain the structure and exterior of Mostyn House School to a good state of repair and; (2) to require each freehold owner to pay MHEMC a rent /service charge. The issues below was the meaning of the freehold instrument.
